多倫多華商會行政總監林綺華表示,就是次事件,邀請了麥律師及Lipkus 律師於星期二,5月31日,早上十時半,於士嘉堡愛靜閣商場中信中心舉行講座及諮詢會,費用全免,希望商人能夠了解更多侵犯商標條例的細節,避免在不知情下觸犯法律條例。

多倫多華商會舉辨講座


一名在唐人街經營牛仔服飾的零售商,去年某天被兩位律師搜查其店舖內的牛仔褲,並指出其銷售的貨品侵犯商標條例,在其職員同意下帶走部份貨品。由於此零售商的貨品並沒有品牌,所以並不認為有侵犯商標的意圖,亦末有正視事件及回應指控。直至兩個多星期前,再接獲律師信被控告侵犯商標並須繳付五千多元法律費用,方向多倫多華商會求助。

就此例子在加拿大零售業出現日趨嚴重,多倫多華商會藉此舉辨講座,邀請該會法律顧問麥劉慧華律師及專門處理侵犯商標案件的資深律師 Lorne Lipkus ,向商人講解此類案件的原由,並呼籲商人提高警覺,避免蒙受金錢上的嚴重損失。

麥劉慧華律師及 專門處理侵犯商標案件的資深律師Lorne Lipkus兩人都有超過十多年處理侵犯商標案件的經驗。從多年工作經驗中,指出侵犯商標案件在加拿大甚為普遍,但部份零售商並未意識到其嚴重性。他們指出,侵犯商標條例在加拿大各族裔都有發生,有部份商人是售賣了盜用了他人商標的產品,更有大部分零售商戶是在不知情的情況下售賣了侵犯商標的貨品。

The Toronto Chinese Business Association (TCBA) was recently approached by a retailer for support after becoming involved in a legal action for inadvertently infringing on a garment product – a phenomenon not uncommon for small independent retail businesses.

In light of this, the TCBA will organize a seminar with legal experts sharing information on issues such as product infringement, the sale of counterfeit products and financial implications of being sued for product infringement.
